Law 12/2023, of 24 May, on the right to housing, approved in Congress on 27 April 2023, and in the Senate on 18 May, which has been in force since the day after its inclusion in the BOE, on 26 May 2023, provides in Section 1 of Article 20 that in the case of housing lease contracts ’property management expenses and of formalisation of the contract will be borne by the lessor’.
This regulation DOES NOT apply in the case of lease contracts for use other than housing such as premises, etc. and, in particular, does not apply to seasonal lease contracts. In these cases, the lessee pays one month of the agency’s fees with its corresponding IGIC.
